"ShortTools" ("the Service", "we", "us", "our") provides access to a web application that scrapes, indexes, and analyzes content on YouTube.com to provide YouTube Shorts creators with data-driven tools for channel research and analysis. These terms of use ("Terms") govern your access and use of the Service.
By accessing or using the Service, you accept and agree to be bound by these Terms. These Terms supplement our Privacy Policy, the content of which is incorporated herein by reference.
1. Scope of Service
A. These Terms apply to any person who accesses or uses the Service (referred to collectively as "Users", "you", or "your").
B. No charge is made for your initial use of the Service, however, access to most features requires a subscription purchase. You are responsible for any charges for Internet use at rates determined by your provider.
C. We reserve the right to change the services, products, and features mentioned in the Service at any time, at our sole discretion.
2. Use of YouTube API Services
Our Service utilizes YouTube's Application Programming Interface (API) Services to collect data and provide our features. By using the ShortTools Service, you are agreeing to be bound by the YouTube Terms of Service.
3. Purchases and Subscriptions
A. To access certain features, you must create a User Account and purchase a subscription.
B. We use Stripe as our third-party payment processor. Payment may be made via credit/debit card. You warrant that you are authorized to use the payment method provided.
C. Users are eligible for a full refund within 14 days of their initial purchase. After this period, purchases are considered final.
D. You can manage or cancel your subscription at any time from your Account page. Promotional codes or discounts are valid only on the initial order.
E. We reserve the right to refuse or cancel your order or subscription at our absolute discretion, including in cases of suspected fraud or unauthorized use of a payment method.
4. License to Use Our Service
A. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-sublicensable, revocable, non-transferable license to access and use the Service for your personal or internal business use.
B. The Service, including all underlying software, data, and materials, shall remain our property or the property of our licensors.
5. Restricted Activities
Users shall not under any circumstances: modify, adapt, reverse engineer, decompile or otherwise disassemble any portion of the Service; grant or sell access to a third party to access your User Account; contravene any laws in the use of the Service; cause or launch any programs or scripts for the purpose of scraping, indexing, or data mining in a way that unduly burdens our systems; remove any copyright, trademark, or other proprietary notices; or use the Service in a way that infringes any third party's rights.
6. Privacy
For information regarding our collection and use of information, please refer to the Service's Privacy Policy, which is incorporated into these Terms.
7. Termination
Your User Account may be restricted or terminated, without notice, if we determine, in our sole discretion, that there has been a material breach of these Terms, or if your account is flagged for any illegal or suspicious activity.
8. Disclaimer and Limitation of Liability
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE MAKE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, REGARDING THE OPERATION OR AVAILABILITY OF THE SERVICE. YOU EXPRESSLY AGREE THAT YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.
WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR OTHER DAMAGES RELATED TO YOUR USE OF THE SERVICE.
9. Governing Law
These Terms shall be governed by and construed pursuant to the laws of England and Wales. Any dispute arising out of or relating to your use of the Service shall be settled by the exclusive jurisdiction of the courts of England and Wales.
